Mikugraphy Newborn and Toddler Photography Terms and Conditions

Booking and Reservation:

  • A non-refundable 50% deposit of the agreed package is required to secure your booking. This deposit will be deducted from the total session fee.
  • Upon payment, Photographer will reserve the time and date agreed upon by both parties.
  • The remaining balance is due on the day of the photo session.

Cancellation, Rescheduling and Late Arrivals:

  • In the event of cancellation, the deposit is non-refundable. However, clients may reschedule the session at least 7 days before the scheduled date without forfeiting the deposit.
    • Rescheduling is subject to photographer availability.
  • In the event that the Client requests to reschedule a session, the deposit shall be applied to a reschedules session if notice is given at least 7 days prior to the schedule event. Reschedule must be within the same calendar year.
  • Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session.

Session Details:

  • The duration of the newborn or toddler photo session is approximately 1 – 4 hours. Subject to the package enrolled.
    • The session may take place at the photographer’s studio or an agreed-upon location. Any travel fees for locations beyond Penang Island will be discussed and agreed upon beforehand.

Client Cooperation:

  • Clients are responsible for the behavior of their child during the session. The photographer is not liable for any difficulty in capturing quality photographs if the child is uncooperative or in distress.
  • Parents are encouraged to bring any special toys, blankets, or props that may help comfort the child during the session.

Safety Precautions:

  • The safety and well-being of the newborn or toddler are the top priority during the session. The photographer will take all necessary precautions to ensure a safe environment, and parents are expected to follow any safety instructions provided.

Liability:

  • The photographer is not responsible for any injuries or accidents that may occur during the session, especially if they result from the child’s actions or behavior.

Image Delivery:

  • The photographer will provide a selection of edited images for the client to view in a private online gallery within 2 – 4 weeks.
  • Clients will have the option to purchase additional digital files, prints, or products at an additional cost.

Usage and Copyright:

  • The photographer retains the copyright to all images and may use them for promotional purposes, including but not limited to portfolio entries, social media, website, competitions and marketing materials. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.
  • Clients are granted a personal print release for the purchased digital files, allowing them to print for personal use only.

Failure to Perform:

  • If the Photographer is unable to perform the session due to baby’s disposition, condition, or circumstances listed within this contract, the Client shall be allowed to reschedule at Photographer’s discretion.
  • If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.

Creative License:

  • Images are edited at Photographer’s discretion, and delivered digitals and/or prints may not include all images shot. Photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within Photographer’s artistic standards. Basic editing is included for all sessions, including minor blemish removal, minor background distractions, etc. Extensive detailed editing will be charged per image at RM150/image. Posed newborn images include more extensive editing such as skin softening, redness removal, blemish removal, skin tone correction, background fix, etc.

Reshoots:

  • Photographer does not offer free reshoots on the basis of client regret over wardrobe choice, location choice, etc.
  • In the unlikely event that Client is completely dissatisfied with the final results based solely on personal preference, Photographer may reshoot at a 25% discount from the original session fee. Client will receive digital images from the second portrait session only and the image files from the original session will be deleted. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera failure or exposure problems), Photographer will reshoot at no additional charge.

By booking a newborn or toddler photography session with Mikugraphy, clients acknowledge that they have read, understood, and agreed to these terms and conditions.
